National Center on Sexual Exploitation Targets Law Allowing Tech Companies to Profit from Online Sex Abuse
The National Center on Sexual Exploitation (NCOSE) has launched a campaign to reform an outdated law effectively allowing tech companies to aid, abet and profit off online sex abuse. Congress passed the Communications Decency Act (CDA) in 1996 to protect children from online exploitation. It included Section 230, a carveout preventing “interactive computer services” from liability for content users posted online.

New Jersey was the first state to acknowledge the dangers of “revenge porn,” banning the trend in 2004. Alaska followed its lead in 2006, and then Texas years later in 2015. More states jumped on board, often dealing with the confusing legality of protecting First Amendment rights, not having previous court cases to go off of, and addressing the ever-changing landscape of social media and deepfake technology.

On April 22, Kelly Armstrong, the Republican governor of North Dakota, vetoed a bill passed by the state legislature that would have required public schools (and libraries) to ensure that books containing pornographic and other sexually explicit content are inaccessible to children. In a move that has received favorable coverage from left-leaning media outlets but largely escaped conservative scrutiny, Armstrong alleged that the proposed law would constitute a “misguided attempt to legislate morality through overreach and censorship.”

The Take It Down Act addresses three common kinds of online exploitation: revenge porn, AI-generated porn and sextortion. The act makes it illegal to publish nude images, both real and AI-generated, without the subject’s consent. It also requires social media companies remove nonconsensual explicit images within 48 hours of a victim’s request.

The House on Monday overwhelmingly passed a bill backed by first lady Melania Trump that cracks down on the posting of explicit images, including “deep fake” nudes generated of people by artificial intelligence, without consent. The Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks – known as the TAKE IT DOWN Act – was approved by a 409-2 vote and now heads to President Donald Trump’s desk.
